Providing PPE for workers is every employer’s responsibility. Regulation 4 of the Personal Protective Equipment at Work Regulations 1992 states that employers must ensure all your workers are safe and protected while in the workplace. You need to take steps to make sure these risks are controlled and that suitable protection is worn or used by your employees who may be exposed to health and safety risks while at work.
In order to provide PPE for their employees, you as employers must do more that simply have the equipment on the premises. You must make sure that workers have ample training, the equipment is available, and have clear instructions on the location and how to obtain it.
Employers cannot ask for money from an employee for returnable PPE items such as faceshields, lab coats, etc. If employment has been terminated and the worker keeps the PPE without your permission, then the employer may be able to deduct the cost of the equipment from any wages owed, but only if this has been clearly stated in the employment contract.
