Legislation to look out for in 2008
APRIL Corporate Manslaughter Act
As of the 6th April 2008, the Corporate Manslaughter and Corporate Homicide Act 2007 comes into force. This new legislation makes it easier to prosecute companies and other large organisations when gross failures in the management of Health and Safety result in a death. For the first time Crown bodies, such as Government departments, will be liable to prosecution.

Organisations that are prosecuted are likely to face fines from 2.5 – 10% of annual turnover and could be forced by the courts to publicise details of their conviction in the media.

JUNE REACH Regulations
From the 28th June 2008, suppliers of products classified under REACH will be obliged to carry out an inventory of all stock and identify where in the supply chain the chemicals come from. You will also have to:
- Submit information to the European Chemicals Agency (ECHA) on the hazardous properties of all substances.
- Prepare risk assessments and provide control measures for using the substances safely.
- Provide a registration dossier to the ECHA primarily to ensure no unnecessary animal testing is conducted.

JAN More changes to WEEE Legislation
As of the 1st January 2008 changes have been made to the Waste Electrical and Electronic Equipment (WEEE) Directive. This means that businesses that are responsible for compliance schemes need to report their activities in a more accurate way (e.g. report in kilograms rather than tonnes).
