Smoking Shelters – Legal Obligations
The English smoking legislation outlines the legal obligations of an organisation that is willing to provide a smoking shelter for their employees. The shelter must comply with the following: |

Any shelter provided for staff or visitors must not be substantially enclosed - this is classified as a structure with a ceiling or roof, which has an opening in the walls, which is more than half the total area of the walls. The area of the opening does not include doors, windows or any other fittings that can be opened or shut. This applies to both newly built shelters and shelters that have been purchased and/or erected before the 1st July 2007. |

It is recommended that any plans to erect a smoking shelter should be discussed with the local council as planning permission may be required. |

Cigarette Bins
There is no official legislation relating to the provision of cigarette bins, but it is highly likely that cigarette litter will be an issue in most organisations where there are none provided. Simple signs reminding smokers to dispose of cigarette butts hygienically can be highly effective. |
